High Court Dismisses Dr Nandipha Magudumana’s Urgent Application With Costs

High Court Dismisses Dr Nandipha Magudumana’s Urgent Application With Costs. A couple of days ago, she made news after engaging a top lawyer experienced with international cases. Dr Nandipha Magudumana roped in Senior Counsel, Advocate Anton Katz, to prove that her arrest in Tanzania was unlawful.

The celebrity doctor is currently behind bars for allegedly aiding and abetting Thabo Bester’s escape from Mangaung Correctional Centre in May last year. The two were caught in Tanzania, after being on the run for a couple of weeks. After abandoning her bail application, Magudumana made news by filing an urgent application to have her arrest declared wrongful and unlawful.

Different views were shared online, after it was revealed that she is being represented by Katz. Her advocate, claimed that some agree that some of her rights were infringed during her arrest and deportation. According to Katz, his client should have been asked for consent before being deported to South Africa. Katz said it needed to be established what Home Affairs and South African Police Service officials were doing in Tanzania. He then went on to explain the difference between a deportation and an extradition.

Despite all this, Magudumana has lost her case, with costs. Judge Phillip Loubser ruled against her claims that she was blindfolded and abducted in Tanzania. This also means that she will remain in custody at the Kroonstad Correctional Centre and face trial for her case. As expected, social media is having a field day.
