Just because you don’t mention the person you’re tweeting/talking about, it doesn’t mean you can’t get in trouble. If enough people can deduce who it is you’re alluding to, then that person can still press charges and most likely win the case.
Basetsana Khumalo
In 2019, controversial author Jackie Phamotse was charged with crimen injuria following comments that she made about Basetsana and Romeo Kumalo in 2018. The Kumalos were granted a protection order by the same court when Phamotse was ordered not to mention them on social media and to also refrain from making allegations about them.
Jackie tweeted, “Just overheard a painful conversation, a female TV mogul pleading with one of my girls to not share videos of her drunk and her husband (sic) rimming a celebrity boy!!!!!!!!! What the hell!!!! Kanti, what kind of marriages do we have now!!! I have asked to see this video.”
DJ Fresh
In 2020, The High Court in Johannesburg ordered controversial poet and singer Ntsiki Mazwai to stop making any further statements regarding media personality DJ Fresh after she called him a rapist on social media. This came after Fresh approached the court, seeking to force Ntsiki to retract her statement.
Ntsiki posted, “I’m on Facebook and there is a thread exposing celebrity rapists… I’m posting all. I’m starting with the allegation against DJ Fresh. because famous men abuse their power.“
Uyanda Mbuli
In 2018, Joyce Molamu, who accused media personality Uyanda Mbuli of having an affair with her boyfriend, was sentenced to a R6 000 fine or face four months’ imprisonment for her Facebook post. The imprisonment was suspended for three years on condition that she does 350 hours of community service and commits to a treatment programme for a period of eight weeks.
Mbuli laid a crimen injuria case against Molamu for her defamatory statements.
Khaya Dlanga
A few days ago Khaya Dlanga tweeted that he will take the Covid-19 vaccine, once it becomes available in SA. Some people came after the YouTuber and author saying that he has been paid to promote the vaccine. Instead he took the legal route, and one tweep had to apologize publicly for her statement.
